Welcome to NetForward, a portable, permanent e-mail service. Netforward started in 1995, was the worlds first FREE, portable, permanent e-mail service. NetForward (NF) provides its service to you (user), subject to the following Terms of Service ("TOS"), which may be updated by us from time to time without notice to you. As a user on the NetForward system, you are required to honor all the terms and conditions set forth here. Existing users that are not able to honor all the terms set forth should contact NetForward immediately for account cancellation. Continuing your use of NetForward, signifies your agreement to the all rules and guidelines set forth.

Cost Of Service

NetForward is a pay service supported by its users. Each user pays a yearly base $10.00 subscription based upon the service that are chosen. All payments must be in U.S. funds drawn on a United States bank.

Description Of Service

Located in College Station, Texas, USA, NetForward provides users with an e-mail and website forwarding service. All features and enhancements of NetForward, current and in the future, shall be subject to the TOC. As a user of NetForward, you understand and agree that the service is provided "AS-IS" and NetFoward assumes no responsibility for deletion or mis-delivery of email or failure to store any users communications or personal settings.

In order to use NetForward, you must obtain access to the World Wide Web, either directly or through devices that access web-based content. You may be required to pay for any fees associated with acquiring such access. It is either your responsibility or your providers responsibility to provide all the equipment necessary to make the connection to the World Wide Web, including such peripherals as: computer, modem, phone line, etc.

Your Obligations As A NetForward User

In consideration of you as a NetForward member, you agree to:

provide true, accurate, current and complete information about yourself as prompted by the registration form.

maintain and promptly update the information in your account to keep it true, accurate, current, and complete.

If NetForward has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, NetForward has the right to suspend or terminate your account and refuse any and/or all current or future use of the service

NetForward may only be use for lawful purposes. User are expressly prohibited from using NetForward for any activity that violates any local, state, national, or other law. User also agrees to comply with all applicable local, state, national laws, regulations, or conventions. Users are also expected to follow common Internet "netique".

NetForward will cooperate with any and all officials to prosecute any user involved in illegal activities using the NetForward service.

Right to Privacy

You have a right to expect privacy in the handling of your information, especially for your electronic mail. It is our intention that the Electronic Communications Privacy Act (United States) apply to your account. We will not intentionally disclose the contents of private files without the user's permission or proper documentation from a legal authority. We cannot ensure total privacy of your e-mail due to the fact that occasionally e-mail is improperly addressed or routed and must be examined to determine the cause of the error. Do not send by e-mail any information that you would not wish to have scrutinized by the public. We are under an obligation to cooperate with law enforcement officials in the justified investigation of alleged unlawful activity.

You are responsible for maintaining the confidentiality of your password and account information, and your are fully responsible for all activities that occur under your password or account. You agree to immediately notify NetForward of any unauthorized use of your password or account or any other breach of security. NetForward cannot and will not be liable for any loss or damage arising from your failure to comply.

NetForward will not sell our subscriber list to any outside entities. As part of the sign-up procedure, you are given the ability to request mailings regarding certain items of your choosing from NetForward.

Our Privacy Policy

Member Conduct

You understand that all information: data, text, software, music, sound, photographs, graphics, video, messages, or other materials, whether publicly posted or privately transmitted, are the sole responsibility of the person from which such information originated. You are solely responsible for all information that transmitted via the NetForward service. NetForward does not control any information transmitted therefore, NetForward does not guarantee the accuracy, integrity or quality of such information. You understand that by using NetForward, you may be exposed to information that is offensive, indecent or objectionable. Under no circumstances will NetForward be liable in any way for any information, including, but not limited to, for any errors or omissions in any information, or for any loss or damage of any kind incurred as a result of the use of any information view, posted, emailed or otherwise transmitted via the NetForward service.

Users must abide by the following guidelines:

Never use a NetForward address in conjunction with an auto-responder system. Repeatedly sending a user e-mail with the intent to harass or harm their account is strictly forbidden. This is generally called "Spamming" or "Mail Bombing" on the Internet.
Impersonate any person or entity, including, but not limited to, a NetForward Official, or falsely state or otherwise misrepresent your affiliation with a person or entity
Forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted through the NetForward service
Email or otherwise transmit any information that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under non disclosure agreements)
Email or otherwise transmit any information that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party
Email or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation
Email or otherwise transmit any unsolicited or unauthorized adult nudity or other such adult materials.
Email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment
Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the NetForward Service
Intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law
"Stalk" or otherwise harass another

International Usage

Since the Internet is not restricted to the United States, you agree to comply with all local rules regarding online conduct and acceptable information. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.

Your Freedom Of Speech

While the freedom of speech is protected by the First Amendment of the United States Constitution, any activity, action or e-mail from any NetForward user that triggers complaints, hate-mail, or blocks on our Domains at a particular site is prohibited. Dealing with these complaints ties up computer and human resources at NetForward. Resources that should be used to maintain the system and support our user base.

Modifications To Service

NetForward reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. You agree that NetForward shall not be liable to you or to any third party for any modification, suspension or discontinuance of the NetForward service.

Account Termination

You agree that NetForward, in its sole discretion, may terminate your account, and remove and discard any information within the service, for any reason, including, without limitation, for lack of use or if NetForward believes that you have violated or acted inconsistently with the TOS. NetForward may also in its sole discretion and at any time discontinue providing the service, or any part thereof, with or without notice. You agree that any termination of your access to the service under any provision of this TOS may be effected without prior notice, and acknowledge and agree that NetForward may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the service. Further, you agree that NetForward shall not be liable to you or any third-party for any termination of your access to the service.

Disclaimer Of Warranties

Your use of the service is at your sole risk. the service is provided on an "AS IS" and "AS AVAILABLE" basis. NetForward expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
NetForward makes no warranty that the service will meet your requirements, the service will be uninterrupted, timely, secure, or error-free, the results that may be obtained from the use of the service will be accurate or reliable, the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and any errors in the software will be corrected.
Any material downloaded or otherwise obtained through the use of the service is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
No advice or information, whether oral or written, obtained by you from NetForward or through or from the service shall create any warranty not expressly stated in the TOS.

Indemnify and Hold Harmless

User agrees to behave in an ethical manner regarding the use of service from NetForward. User further agrees to indemnify and hold harmless NetForward, and its owners, employees, and agents for any consequences of their actions. User also agrees to abide by all state and federal laws governing the use of telecommunications and computers in the United States. Users understand that NetForward exercises no control whatsoever over the content of the information passing through the Internet. NetForward makes no warranties of any kind, whether expressed or implied, for the service it is providing. NetForward also disclaims any warranty of merchant ability or fitness of a particular purpose. NetForward will not be responsible for any damage you suffer. This includes loss of data resulting from delays, non-deliveries, mis-deliveries, or service interruptions cause by its own negligence or your errors or omissions. Use of any information obtained via our service is at your own risk. NetForward specifically denies any responsibility for the accuracy or quality of information obtained through its services.

Governing Law

Our on-line system can be reached by users from our principle place of business, Brazos County, Texas, and around the world. Any legal matters about NetForward shall be governed by and interpreted in accordance with the laws of the State of Texas, USA.
